Terms of Use and Public Offer
Rules for using Truck Hub, the request auction, the SafePay service, and dispute resolution.

1. Definitions
- 1.1"Platform" — the Truck Hub web service at truckhub.biz and the mobile applications providing access to the Platform.
- 1.2"Operator" — LLC "Bars Art" (Ukraine), which administers the Platform.
- 1.3"User" — any person using the Platform: Customer, Carrier, Driver or Guest.
- 1.4"Customer" — a user who places a request for the transport of goods or passengers.
- 1.5"Carrier" — a user who offers transport services using own or engaged vehicles and is responsible for completing the trip.
- 1.6"Request" — a description of a transport (route, cargo, deadlines, payment terms) placed by the Customer for auction.
- 1.7"Bid" — the Carrier's offer to fulfil the Request at the stated price and terms.
- 1.8"Trip" — a transport that arises after the Customer selects the Carrier's Bid.
- 1.9"SafePay" — a secure payment mechanism whereby the Customer's funds are held in reserve until confirmation that the Trip has been completed.
- 1.10"Trust Score" — a user's trust rating formed on the basis of verified documents, completed Trips, discipline and reviews.
2. Subject of the agreement and acceptance
- 2.1This document is a public offer by the Operator to conclude an agreement to provide access to the Platform on the terms set out herein.
- 2.2Acceptance of the offer occurs upon registration on the Platform or any actual use of it, including in guest mode.
- 2.3The Operator provides an information-technology service: posting requests, conducting the auction, trip support, secure settlements and the reputation system. The Operator is not a carrier, freight forwarder, or a party to the contract of carriage between the Customer and the Carrier.
- 2.4The contract of carriage is concluded directly between the Customer and the Carrier at the moment the Bid is selected; its terms are recorded in the Trip card and in the agreement generated by the Platform.
3. Registration, verification and guest mode
- 3.1To register, the User provides accurate name, email and phone number; the Carrier also provides company or sole-trader details.
- 3.2Full access (publishing requests, participating in the auction, receiving payouts) is granted after verification: confirming email and phone, and having documents checked by the Platform's administrator.
- 3.3Guest mode allows you to explore the dashboard and put together a test request without registering. In guest mode it is not possible to publish a request, place or accept a bid, or see other users' contacts.
- 3.4The User is responsible for keeping their account credentials secure and for all actions performed under their account. Any suspicion of unauthorised access must be reported to the Operator immediately.
- 3.5The Operator has the right to suspend or block an account in the event of providing false data, violation of these terms, fraud, or the inclusion of the user or their vehicle in the register of blocked entities.
4. Requests and auction
- 4.1The Customer is responsible for the completeness and accuracy of the description of the cargo (passengers), route, deadlines and special conditions (temperature regime, ADR, documents).
- 4.2By placing a Bid, the Carrier confirms the availability of appropriate vehicles, permits, insurance, and the ability to complete the Trip within the specified time frame.
- 4.3A Bid is the Carrier's commitment to complete the Trip on its terms if selected by the Customer. A Bid may be withdrawn before it is accepted.
- 4.4The Customer freely chooses a Bid, guided by the price, terms and the Carrier's Trust Score. Once a Bid is chosen, the request is removed from the auction and the other Bids are declined.
- 4.5The Platform may display a recommended price, calculated automatically. It is for reference only and does not bind the parties.
5. Trip execution and GPS monitoring
- 5.1The Carrier assigns a driver and vehicle and ensures the trip stages are completed in the driver's app: confirmation, arrival for loading, photos of cargo and seals, transit, unloading.
- 5.2During the trip, the driver's app transmits GPS coordinates. The Customer, Carrier and the Platform's dispatcher see the route, deviations from the schedule, and the trip status.
- 5.3Photo evidence at the loading and unloading stages is mandatory and is used as proof of the cargo's condition when resolving disputes.
- 5.4The Customer confirms delivery in the dashboard after unloading. If there is no confirmation or dispute within 48 hours of the unloading mark, the Platform's dispatcher may confirm delivery based on the GPS track and photos.
- 5.5Changing trip terms (price, deadlines, route) is possible by mutual agreement of the parties through the "Change terms" section in the trip card.
6. SafePay service rules
- 6.1SafePay is a secure payment mechanism whereby the Customer reserves the cost of the trip on the Platform before it begins, and the Carrier receives payment after delivery is confirmed.
- 6.2Reservation: funds equal to the Bid price are reserved after the Carrier is selected. Before reservation, the Carrier is not obliged to start the trip.
- 6.3The Platform's commission is deducted from the payout amount to the Carrier at the rate specified in the Rates at the time the Bid is selected, and is shown in the trip card before confirmation.
- 6.4Payout (Full Payout): after delivery is confirmed by the Customer or dispatcher, funds less the commission are transferred to the Carrier within 3 banking days.
- 6.5Freeze: if either party opens a dispute, the funds are frozen until the Platform's arbitration decision.
- 6.6Refund (Full Refund): if the trip fails through the Carrier's fault, or the cargo is lost or damaged due to their fault, the funds are returned to the Customer in full.
- 6.7Partial Payout (Split Payout): by arbitration decision, the amount may be split between the parties, for example, payment for the actual distance covered to the Carrier and a partial refund to the Customer for delays.
- 6.8Penalties: for violation of terms (unjustified refusal of a trip, missed deadlines, false data), the Platform may withhold a penalty from the SafePay amount or the balance of the party at fault, in accordance with the Rates.
- 6.9SafePay is not a bank deposit and does not accrue interest. Settlements are made through the Operator's payment partner.
7. Trust Score and reputation
- 7.1The Trust Score is calculated automatically based on verified documents, the number of completed trips, schedule compliance, reviews and the absence of disputes.
- 7.2Reviews are left only by participants in completed trips and cannot be deleted at the request of the rated party, except in cases of violation of the Platform's rules.
- 7.3The Platform Administrator may manually adjust the Trust Score based on the outcome of an appeal review or detection of manipulation.
8. Disputes and arbitration
- 8.1A dispute is opened from the trip card by the Customer or Carrier, stating the reason. From the moment the dispute is opened, the SafePay funds are frozen.
- 8.2The Platform's Arbitration reviews a dispute based on the trip chat correspondence, photo evidence, GPS track, documents and the parties' explanations. Review period — up to 5 business days.
- 8.3Based on the review, the administrator makes one of the following decisions: full payout, full refund, partial payout, or a penalty for the party at fault.
- 8.4The arbitration decision is binding within the Platform. The parties retain the right to go to court under the laws of Ukraine.
9. Liability
- 9.1The Carrier bears full responsibility for the safekeeping of the cargo, passenger safety, and compliance with transport legislation and customs and border regulations.
- 9.2The Customer is responsible for the accuracy of the cargo description, the availability of accompanying documents, and the legality of the transport.
- 9.3The Operator is responsible for the Platform's operability and data retention, but is not liable for non-fulfilment of obligations by the Customer or Carrier, actions of third parties, or force majeure.
- 9.4The Operator's total liability to the User is limited to the amount of commission paid for the relevant trip.
10. Personal data and privacy
- 10.1The processing of personal data is carried out in accordance with the Privacy Policy, which is an integral part of these terms.
- 10.2The User consents to the processing of data necessary for the Platform's operation, including the disclosure of contacts to the other party of the trip after a Bid is selected, and the driver's GPS data to trip participants.
11. Changes to the terms and termination
- 11.1The Operator may amend these terms by publishing a new version on the Platform at least 7 days before it takes effect. Continued use constitutes agreement with the new version.
- 11.2The User may stop using the Platform at any time; obligations relating to unfinished trips and settlements remain in force until fulfilled.
